“Anti-Trust, Anti-Corruption & Industrial Policy in China -“How Should MNCs in China Manage These Risks?"

Dear AMCHAM Members,

Following the transition to the “Fifth Generation” of PRC leadership under President Xi Jinping, multinational companies face intensified enforcement of Chinese laws against anti-competitive conduct and bribery. Chinese competition regulators and courts have penalized both domestic and foreign parties for price-fixing, resale price maintenance, and abuse of standard-essential patents. Communist Party disciplinary authorities and law enforcement are pursuing both givers and recipients of bribery in cases involving state-owned companies and institutions.

Even as China explores new reforms through the pilot Shanghai Free Trade Zone and the resumption of Bilateral Investment Treaty negotiations with the U.S., serious questions persist about the interplay of industrial policy and politics in Chinese competition policy and anticorruption campaigns. How should multinational companies active in China manage these risks? Nate Bush will assess the current regulatory climate and compliance strategies for multinational companies in China.

Nathan G. Bush ("Nate") is a Litigation partner in the Beijing and Singapore offices of O’Melveny & Myers LLP. Nate’s practice focuses on regulatory investigations, commercial disputes, and litigation concerning antitrust and competition, fraud and corruption, and international trade. He was based in Beijing from 2004 through 2012, serving as General Counsel of the American Chamber of Commerce in China from 2009 through 2011. He frequently publishes and speaks on competition and trade policy in Asia, and authored the China chapter of the ABA treatise on COMPETITION LAWS OUTSIDE THE UNITED STATES. Nate is a graduate of the Harvard Law School and the University of Virginia.
