    EVENT DESCRIPTION
    Join us for an ICDR-AMCHAM meeting, which will explore how litigation tools can be used to support international arbitration. From freezing assets pre-arbitration to compelling discovery, and to enforcing arbitral awards, the panelists will share their experience in utilizing various tools in court litigation and arbitration proceedings to maximize the chance of settlement (both on the offensive and defensive sides) in cross-border disputes. Focusing primarily on the United States and South Korea, this session will offer practical insights on using litigation tools more aggressively for the effective resolution of cross-border disputes.

    About the Speakers
    • [Moderator: Korean Panel] Kevin Kim, Partner, Peter & Kim

      Kap–You (Kevin) Kim is the managing partner and founder of Peter & Kim in Seoul. He was previously a senior partner at Bae, Kim & Lee LLC, where he worked for the past three decades in various roles, including as the co–founder and head of the International Arbitration Practice and the head of the Domestic and International Disputes Group.  Over the past 30 years, Kevin has acted as counsel, presiding arbitrator, co-arbitrator or sole arbitrator in more than 350 international arbitration cases under various arbitration rules. Presently, he is involved in several investment and commercial arbitrations.  Among other positions that he holds, Kevin is an Advisory Board Member of the ICCA and the Chairman of the KCAB’s International Arbitration Committee. 
    • [Moderator: English Panel] Arie Eernisse, Senior Foreign Attorney, Peter & Kim

      Arie Eernisse is a senior foreign attorney at Peter & Kim and has been practicing international arbitration in Asia for the past decade. Qualified in New York and England & Wales, Arie acts as counsel in commercial and investment arbitration matters governed by the rules of various arbitral institutions, such as ICC, KCAB, HKIAC, SIAC, LCIA, as well as in ad hoc arbitration matters and cross-border litigation matters. He also sits as an arbitrator. Arie is a Fellow of the Chartered Institute of Arbitrators, the Hong Kong Institute of Arbitrators and Singapore Institute of Arbitrators and is listed as a panelist of the KCAB, HKIAC and SIAC. In addition to his counsel and arbitrator work, he currently serves as co-chair of the AMCHAM Korea Legal Affairs Committee.
    • [Panelist: English & Korean Panels] Seokchun Yun, Partner, Peter & Kim

      Seokchun Yun is a partner at Peter & Kim in Seoul, specializing in international arbitration and cross-border litigation, international trade, international taxation, construction and real estate litigation, and shareholder disputes with a focus on disputes with international elements. He provides legal advice on potential disputes and is regarded as one of the highly respected experts in the field. Mr. Yun has represented the Republic of Korea in two of the biggest ISDS cases and is renowned for his deep understanding and expertise in PE-related disputes, as well as complex financial, fiscal, accounting, and tax issues. Having majored in Civil Procedure at a graduate school and possessing experience in both Korean and US (federal and state) litigation, he has played a major role in multiple Korean court proceedings for foreign clients and has been involved in several US court proceedings for Korean clients.
    • [Panelist: English & Korean Panels] Ara Cho, Partner, Peter & Kim

      Ara Cho is a partner at Peter & Kim in Seoul. As a Korean qualified lawyer since 2011, Ara has represented clients in numerous international arbitrations under the rules of the ICC, LCIA, SIAC, and KCAB, seated in various jurisdictions and governed by various legal systems including English, Canadian, Japanese and Korean law. Ara has acted as counsel in cases concerning a range of large-scale international projects including thermal power plants in Middle East, a nuclear power plant in Middle East, a refinery plant in Africa and real estate developments in Korea and Australia, as well as distribution contracts concerning pharmaceutical products and others. Ara is listed as arbitrator in KCAB and HKIAC. She is currently Swiss Arbitration Association Ambassador for Korea and a faculty member at Delos Remote Oral Advocacy Program.
    • [Panelist: English Panel] Jef Klazen, Partner, Kobre & Kim

      Jef Klazen focuses on international judgment enforcement and complex commercial litigation. In the context of pursuing creditor-side recovery worldwide, he has significant experience throughout Asia, Europe, offshore jurisdictions, and the U.S., frequently implementing discovery mechanisms in these courts to uncover hidden assets. Described by the publishers of Global Arbitration Review as “renowned for his deep expertise in asset recovery” and his “excellent written advocacy,” he advises companies and individuals on how to monetize their legal claims and judgments. Mr. Klazen also litigates commercial disputes in New York courts and across the United States and is an aggressive advocate for clients in matters involving complex financial products at both the trial and appeal levels. Before joining Kobre & Kim, Mr. Klazen practiced with Cravath, Swaine & Moore LLP in New York.
    • [Panelist: Korean Panel] Robin J. Baik, Partner, Kobre & Kim

      Robin J. Baik focuses his practice on international judgment enforcement and asset recovery matters, including those relating to insolvency proceedings and involving fraudulent schemes to embezzle and hide misappropriated assets. He has represented a diverse range of clients, including sovereign entities, energy and technology companies and financial institutions. Mr. Baik has extensive experience in white-collar criminal defense and regulatory enforcement matters, with a strong emphasis on advising Korean and other Asia-based corporations and individuals in cross-border disputes. Before joining Kobre & Kim, Mr. Baik practiced at Cleary Gottlieb Steen & Hamilton LLP.
