AMCHAM Engages in Dynamic Dialogue on Trade Enforcement Policies and Trends with U.S. CBP and KCS Facilitating Bilateral Trade: AMCHAM Collaborates with KITA in Joint Trade & Customs Seminar April 4, 2024 – The American Chamber of Commerce in Korea (AMCHAM, Chairman and CEO James Kim) co-hosted a joint seminar with KITA featuring representatives from the U.S. Customs and Border Protection (CBP) and the Korea Customs Service (KCS) at the Kim & Chang Crescendo Building this afternoon. Speakers from CBP and KCS gathered to discuss U.S. Customs and Korea Customs trade enforcement policies and trends as well as to hear the opinions of various global companies, including AMCHAM member companies. AMCHAM Chairman & CEO James Kim said, “ Under President Biden and President Yoon, we have witnessed the U.S.-ROK relations reaching unprecedented heights. Bilateral trade and investments have surged, with Korea emerging as the top investor in the U.S. since 2021 and the U.S. becoming the primary export market to Korea as of December last year.” He continued, “CBP and KCS play a critical role in ensuring that trade, especially between the U.S. and Korea, continues to be reliable and fair.” He added, “Companies operating globally need to stay updated about these regulations. We should take proactive measures to ensure that we are complying with changing regulatory requirements and following best practices. AMCHAM will continue to do our best to strengthen the U.S.-Korea trade partnership and assist not only American companies in Korea but also Korean companies expanding into the U.S.” Lee Chul-hun, Director of External Relations Division of Korea Customs Service, said, “The KORUS FTA, celebrating its 12th anniversary this year, stands out as the most significant and successful agreement among the 21 FTAs signed by Korea over the past two decades.” He continued, “This achievement owes much to the close collaboration between the public and private sectors, including import and export firms, government agencies such as customs authorities of both nations, and various related entities.” He added, “KCS recently introduced Smart Innovation strategies in February to adapt to the dynamic trade landscape, aiming to establish both a 'Safer KCS' and a 'More Convenient KCS.'” He emphasized, “We are dedicated to ensuring ongoing communication within the trade industry and fostering robust collaboration with key partners, including the United States.” After a brief introduction by Katrina Chang, Senior Advisor at Kim & Chang and Co-chair of the AMCHAM Trade & Customs Committee, the seminar began with presentations by representatives from CBP. Raymond Irizarry, Director of Textiles & Trade Agreement Division at the Office of Trade at Customs and Border Protection (CBP), delivered an overview of CBP’s Green Trade Strategy. He said, “Since the U.S.– Korea Free Trade Agreement went into effect 12 years ago, our countries have demonstrated tremendous partnership and resilience in the face of evolving and unprecedented challenges. CBP looks forward to strengthening our relationship with Korea in the years to come as we work together to level the playing field for compliant traders and to increase economic growth for both of our nations.” Katie Woodson, Assistant Director of Forced Labor Division at the Office of Trade at U.S. Customs and Border Protection (CBP), shared an update on UFLPA and Forced Labor Enforcement Trends. Following presentations from Foreign Attorney Bae Hyo Jin at Kim & Chang on the topic “Forced Labor Regulations in Other Jurisdictions,” Korea Customs Service presented topics that import/export companies would be interested in, such as “KCS's Enforcement Strategy for E-commerce and IPR Protection” (Jeon DuHan, Deputy Director, Investigation Planning Division), “KCS's 2024 Audit Work Plan"(Moon Ahyoung, Deputy Director, Post-Clearance Audit Division), and “Overview of Foreign Exchange Transactions and Compliance Program” (Kwon ByeongHak, Deputy Director, Financial Investigation Division). ### 주한미국상공회의소, 美 CBP · 韓 관세청 초청 ‘한∙미 합동 관세정책 세미나’ 한국무역협회와 공동 개최 CBP 친환경 무역정책 및 美 위구르 강제노동 방지법 등 한·미 관세행정 최신 동향 및 주요 정책에 대한 심도 깊은 이해를 통해 한·미 양국간 무역 촉진 도모 2024년 04월 04일 – 주한미국상공회의소(회장 겸 대표이사 제임스 김, 이하 ‘암참’)가 오늘 오후 김·장 법률사무소 크레센도 빌딩에서 한국무역협회(KITA)와 공동으로 ‘한·미 합동 관세정책 세미나’를 개최했다. 연사로 참석한 미국 관세국경보호청(CBP)과 한국 관세청(KCS) 등 양국 관세당국 전문가들은 세미나를 통해 한·미 양국 관세행정의 최신 동향 등을 공유하고 암참 회원기업을 포함한 한·미 양국 기업들의 관련 의견을 청취하는 시간을 가졌다. 제임스 김 암참 회장 겸 대표이사는 개회사를 통해, “바이든 대통령과 윤석열 대통령의 리더십 하에 우리는 전례 없이 단단하고 끈끈한 한미관계를 목도하고 있다.”고 말하며, “2021년부터 한국은 미국의 최고 투자국으로 부상했으며, 지난해 12월 기준 미국이 한국의 제1 수출 시장으로 도약하는 등 양국 교역과 투자가 급증했다. 이러한 상승세 가운데 한·미 교역의 신뢰도와 공정성을 제고하는데 있어 CBP와 관세청이 그 핵심 역할을 수행하고 있다.”고 덧붙였다. 그는 또한, “글로벌 시장에서 활동하고 있는 기업들은 끊임없이 변화하는 규제와 최신 정보에 민감하게 대응하여 올바른 기업 운영을 해야 한다.”고 이어 말하며, “암참은 앞으로도 한국 내 미국 기업의 성공과 한국 기업의 미국 시장 진출을 위해 부단한 노력을 이어 갈 것.” 이라고 강조했다. 관세청 이철훈 국제협력총괄과장은 축사를 통해, “올해로 발효 12주년을 맞은 한·미 FTA는 지난 20년간 한국이 맺은 21건의 FTA 중 가장 의미 있고 성공적인 협정.” 이라고 말하며, “이는 수출입업체, 양국 관세당국 등 정부기관, 여러 유관기관 등 민·관의 긴밀한 협조가 있었기에 가능했다.”라고 덧붙였다. 그는 또한, “최근 관세당국은 하루가 다르게 변화하는 무역환경에 대응하기 위해 지난 2월 스마트 혁신 전략을 발표하고 ‘더 안전한 관세청’, ‘더 편리한 관세청’을 만들기 위해 노력하고 있다.”고 말하며, “앞으로도 무역업계 여러분과의 끊임없는 소통, 그리고 미국과 같은 중요한 파트너와 긴밀한 협력을 지속하여 나갈 것.” 이라고 강조했다. 이후 식순은 암참 무역 & 관세 위원회 공동의장인 카트리나 장 김·장 법률사무소 고문의 CBP 연사 소개에 이어 CBP 관계자들의 발표가 이어졌다. 레이몬드 이리자리 (Raymond Irizarry) 美 관세국경보호청(CBP)의 Textiles & Trade Agreement Division Director는 먼저, CBP의 Green Trade 전략을 설명하며 “12년 전 한·미 FTA 발효 이래로 한·미 양국은 전례 없는 도전에 수없이 직면하면서도 엄청난 회복력과 파트너십을 보여주었다. CBP는 앞으로도 한국 무역 업계와 협업하여 법질서를 준수하는 업계 종사자들을 위해 공정한 경쟁의 장을 조성하고 양국 경제 성장 증진에 기여할 수 있기를 고대한다.”고 덧붙였다. 또한, 케이티 우드슨 (Katie Woodson) 美 관세국경보호청(CBP)의 Forced Labor Division Assistant Director는 ‘위구르 강제노동 방지법’ 시행 현황과 시사점에 대해 발표를 이어갔다. 이날 세미나에서는 김·장 법률사무소 배효진 외국 변호사의 발표에 이어, 관세청은 이번 세미나에서 수출입기업들이 관심을 가질 만한 주제들로서 “불법 전자상거래 단속 및 지식재산권 보호 활동”(조사총괄과 전두한 사무관), “2024년 관세조사 운영방향” (기업심사과 문아영 사무관), “외국환거래 개요 및 유의사항” (외환조사과 권병학 사무관)에 대해 발표했다.

AMCHAM Meets with Deputy Prime Minister & Minister of Economy and Finance Choi Sang-mok to discuss Korea’s potential as an APAC Regional Headquarters Presented AMCHAM’s recently released “Korea as an Asia-Pacific Regional Headquarters” report, and explored ways to enhancing the business environment in Korea to bolster its competitiveness as an APAC RHQ April 02, 2024 – The American Chamber of Commerce in Korea (AMCHAM; Chairman and CEO James Kim) met Deputy Prime Minister & Minister of Economy and Finance Choi Sang-mok at The Government Complex Seoul today. The AMCHAM delegation, including AMCHAM Chairman & CEO James Kim, President & CEO of GM Korea Hector Villarreal, CEO of Citibank Korea Myung-Soon Yoo, Sr. Country Officer for Korea at Chubb Group Geannie Cho and Senior Advisor of EY Hanyoung Robert Smith, presented AMCHAM’s recently released “Korea as an Asia-Pacific Regional Headquarters (RHQ)” report and explored ways to enhance the business environment in Korea and bolster its competitiveness as an APAC Regional Headquarters. “AMCHAM has witnessed a significant trend where multinational companies are increasingly viewing Korea as a potential regional headquarters in the Asia Pacific region,” remarked AMCHAM Chairman and CEO James Kim. “Recognizing this as a unique opportunity for Korea, we recently published a comprehensive report titled ‘Korea as an Asia-Pacific Regional Headquarters,’ which encompasses enhancements in the regulatory environment which includes labor flexibility, predictability in tax enforcement and the digital economy regulations.” He added, “AMCHAM believes MOEF plays a crucial role in driving policy reforms and RHQ incentive programs, and we are eager to work with MOEF to support these important policy reforms. AMCHAM Explores Opportunities and Challenges in Artificial Intelligence Industries - AMCHAM AI Accelerate Summit 2024 - Exploring the current state of the AI ecosystem, as well as the role of government policies and businesses in fostering the landscape of the AI industry March 21, 2024 - The American Chamber of Commerce in Korea (AMCHAM; Chairman and CEO James Kim) hosted the ‘AI Accelerate Summit 2024’ at the Conrad Seoul Hotel today. Held under the theme “Nurturing Growth for Thriving Businesses,” the event explored innovative industry applications of AI driven by the recent ChatGPT excitement. These applications have led to increased productivity and improved convenience. Additionally, the event offered an overview of the current state of the domestic and international AI ecosystem as well as government policies and the roles of industry, academia, and government in nurturing the AI industry. In his opening remarks, AMCHAM Chairman & CEO James Kim said, “We are witnessing a global embrace of generative AI and machine learning as businesses increasingly leverage these technologies to secure a prosperous future and stay competitive in the market.” He added, “Given Korea’s expanding global influence, we believe that now is the best time for Korea to position itself as a regional innovation hub in the Asia Pacific. It is crucial for Korea to create a sustainable regulatory environment and the appropriate policies are imperative for long-term success.” Yeol Um, Artificial Intelligence-based Policy Officer of the Ministry of Science and ICT, delivered congratulatory remarks. “The Korean government plans to make this year the first year of the AI era and promote various policies to contribute to the nation’s leap and improve the quality of life of the people by capturing new opportunities created by advanced AI technologies such as Generative AI.” He added, “To secure world-class AI technology and foster global talent, we will launch new international joint research and cooperation in the field of AI and data and spend a total of KRW 700 billion won on spreading the use of AI in everyday life, industrial sites, and public administration.” He continued, “We also plan to support the enactment of AI laws that will achieve this in a balanced way, recognizing that the sustainable development of the AI industry is possible in securing AI reliability ethics. In particular, we plan to hold an AI safety summit in Seoul in May to lead the establishment of global norms.” Andrew Herrup, Minister-Counselor of Economic Affairs from the U.S. Embassy Seoul, also pledged the U.S. government’s enthusiasm for collaborating with Korea on AI through his congratulatory remarks. The first session of the summit was opened by Paul Burton, General Manager of IBM Asia Pacific, who gave a presentation on the title “Nurturing Growth for Thriving Businesses.” In his keynote speech, Mr. Burton highlighted that the Asia-Pacific region has long been at the center of global innovation. “To position for step-change growth in a diverse and dynamic economic region, to not only survive but thrive in a time of permanent technological advancement, governments and organizations must place responsible AI development and deployment at the center of national agendas and policies,” he said. He added, “My closing thought for today is that we and leaders all have a responsibility to be fully engaged in the development and life cycle of AI. It’s not somebody else’s job. Ensuring AI is implemented in a careful, methodical, and trusted way across your organizations rests on leaders like you.” Bonhi Gu, Director of Invest Seoul, delivered a presentation on the topic “Hayes Valley of Korea: Seoul's Plan for AI Industry.” Citing practical benefits such as a company-friendly environment and infrastructure, he discussed the attractiveness of Seoul City, which is prepared to foster the artificial intelligence (AI) industry. Kicking off the industry presentations, Eun Young Lim, Leader of Generative AI Group at LG CNS, presented the company’s foray into generative AI and delved into partnerships with global big tech companies such as Google, Microsoft and AWS. Sunny J. Park, Foreign Attorney at Kim & Chang, delivered a presentation under the title “Nurturing Growth for a Thriving Business,” and Juyun Moon, Executive Director of GR Korea, presented under the theme “Status of Policy Discussion on AI in Korea.” Christopher Padilla, VP of Government & Regulatory Affairs at IBM, delivered a presentation on the topic “Global Approach to AI Regulations.” “The government should consider two key factors to successfully build an AI ecosystem in Korea,” he said. “The first is ensuring that legislation reflects the difference in the roles of developers and users, and assigns obligations accordingly. The second is making sure that the regulation should be applied according to the situation in which AI is deployed since AI application is unique. For example, the semiconductor field does not regulate the invention or production of new chips, such as defense industry or automobiles, etc. The same goes for AI.” Following the presentations was a panel discussion led by Sun Hee Kim, Parter at Yulchon LLC and Co-chair of the AMCHAM ICT Committee. Exploring the topic “The Role of Government Policies and Businesses in Fostering Korea’s AI Industry Landscape,” the discussion featured Chul Ki Nam, Director of Artificial Intelligence Policy Division at the Ministry of Science and ICT, William P. Cobb, Deputy Minister for Economic Affairs at the U.S. Embassy Seoul, Barak Shine, Deputy Chief of Mission at the Embassy of Israel in the Republic of Korea, Eun Young Lim, Leader of Generative AI Group at LG CNS, Kibeom Hong, Expert Advisor at GR Korea, and Hyesun Kim, Head of Government Affairs & Public Policy at HP. The Board members highlighted various pressing issues, including the need to improve Labor Flexibility, lessen Energy Costs, eliminate Foreign Exchange Regulations, mitigate CEO Criminal Liability, ease Digital Economy Regulations and enhance Korea’s English Education, as well as greater emphasis on ensuring proactive communication in support of transforming Korea’s position as RHQ. Containing the signatures of 30 members of the Board, this letter is the second instance in which AMCHAM formally appealed to President Yoon with a comprehensive set of policy recommendations. The report also includes the results of the “AMCHAM Business Survey 2024,” an annual survey that details AMCHAM members’ opinions of the state of the Korean business environment. According to the results of the AMCHAM Business Survey 2024, Korea has been ranked as the second most-preferred destination for regional business headquarters in Asia, after Singapore, for the third consecutive year. While 43.7% of respondents rated the current business environment in Korea as average, indicating room for improvement, a notable portion of 31% rated it positively. This suggests that there is a foundation upon which to build and improve, with 66.2% of respondents expressing optimism or neutrality regarding the business outlook for their respective industries in Korea within the next two years. Highlighted concerns in the survey include Korea's unique regulations, which are crucial for establishing Korea as the APAC RHQ. At the ceremony hosted by the Ministry of Economy and Finance, Chairman & CEO James Kim was recognized by the National Tax Service for his contributions to tax cooperation. As Chairman and CEO of AMCHAM, James Kim has served as a bridge between foreign companies and Korean government agencies. He has organized numerous tax-related forums and seminars, facilitating the communication of industry opinions on tax reform and enhancing AMCHAM member companies' understanding of the Korean tax system. In addition, he was recognized for being instrumental in promoting Korea as a regional business hub within the Asia-Pacific region through the establishment of a stable domestic tax environment. AMCHAM Facilitates Industry Dialogue on Online Platform Bill with Korea Fair Trade Commission AMCHAM holds closed-door Roundtable Meeting with KFTC, reinforcing its Crucial Role as Bridge between Industry and Government January 25, 2024 - The American Chamber of Commerce in Korea (AMCHAM; Chairman and CEO James Kim) held a closed-door roundtable meeting with the Korea Fair Trade Commission (KFTC) this morning at the AMCHAM office. The meeting was organized to effectively convey the industry’s perspectives on the proposed “Online Platform Bill.” As part of its continuous efforts to fortify mutual communication regarding proposed regulations between the government and industry, AMCHAM proposed the meeting earlier this year to discuss the case and ensure that the industry’s views could be fully heard and considered. The meeting was attended by AMCHAM Chairman & CEO James Kim, along with other key stakeholders in the global platform industry. The KFTC provided a thorough overview of the goals and essential provisions outlined in the proposed regulations, and representatives of global platform businesses in Korea exchanged opinions on challenges and suggestions related to the proposed “Online Platform Bill” and explored ways to improve the business environment.
