“Increased Litigation Disputes in Korea ? Is Korea headed for trouble?”

Presentation Summary
 
On November 7th, Sc?vole de Cazotte (VP of International Initiatives at the U.S. Chamber’s Institute for Legal Reform) shared with us his experience and observations regarding the global spread of U.S.-style litigation. During his presentation, Mr. de Cazotte touched on important class action developments throughout Europe?both at the EU institution level in Brussels and member states, such as the United Kingdom and the Netherlands?as well as in the Asia-Pacific, including recent class action proposals in Korea. He also addressed the rapid growth of third party litigation funding (TPLF)?a worldwide industry with hedge funds actively investing in litigation across the globe. Litigation funders have now set their sights on Asia, which could have a substantial impact in Korea. His presentation outlined several safeguards that can help guard against some of the worst effects of misguided class action and TPLF proposals. However, Mr. de Cazotte stressed that it is equally important for the business community to engage early and often on these issues to ensure that we don’t create our own U.S.-style litigation abuses.
