AMCHAM Hosts Key Seminar on U.S. Work Visa Process

Seminar provides essential insights and expert guidance for

Korean businesses and individuals looking to expand into the U.S. market

August 14, 2024 - The American Chamber of Commerce in Korea (AMCHAM; Chairman and CEO James Kim) hosted a highly informative seminar on the U.S. work visa process this afternoon at the IFC Forum.

The event attracted a diverse and engaged audience seeking insights from experts on navigating the full spectrum of U.S. work visas, reflecting the heightened interest among Korean companies and individuals in expanding into the U.S. market. The seminar delivered a comprehensive overview of U.S. work visas, addressing both individual and corporate needs. It provided a valuable opportunity for attendees to gain a deep understanding of various visa categories, their specific requirements, and the business activities permitted under each visa type.

AMCHAM Chairman & CEO James Kim said, “For the last three years, we have witnessed an unprecedented level of Korean investments in the U.S., totaling over USD $140 billion in strategic industries such as semiconductors, EV batteries, and renewable energy. As an organization that bridges U.S.-Korea commerce, AMCHAM recognizes the strong momentum in bilateral industrial collaboration.”

He continued, “It is crucial that these significant investments are supported by all available mechanisms, and we are especially grateful for the efforts of U.S. Consular Affairs, CBP, MOTIE, and MOFA in facilitating these opportunities on the ground. In this context, I believe today’s session will provide valuable insights into the U.S. work visa process, helping Korean companies and their employees navigate it more effectively.”

Andrew Gately, Minister-Counselor for Commercial Affairs at the U.S. Embassy Seoul, said in his congratulatory remarks, “Korea is a trusted supply chain partner for the United States, and establishing facilities in the U.S. involves critical staff deployments. It is imperative that these deployments occur properly, with the appropriate visas, to ensure the success of Korean investments.” He underscored, “The U.S. Embassy is committed to supporting further Korean investment, recognizing the immense value Korean businesses bring to the U.S.”

Keynote speaker Man Suk Jung, U.S. Attorney at Daeyang Immigration Law Group, emphasized, “Addressing visa issues is the first crucial step for establishing a presence in the U.S. We hope this seminar will pave the way for Korean companies to expand into the U.S., creating a positive impact on fostering economic growth for both countries.”

The seminar also featured a panel discussion with experts from Daeyang Immigration Law Group, the Korea International Trade Association (KITA), the Consulate General of the Republic of Korea in Houston, and U.S. Customs and Border Protection at the U.S. Embassy. This session offered invaluable insights into the U.S. work visa system, addressing critical legal considerations and common applicant challenges.

Hee Chul Jung, Director of the International Cooperation Department at KITA, provided an update on the current landscape of Korean investments in the U.S., highlighting key trends and sectors such as technology and renewable energy. Consul General of the Republic of Korea in Houston Young-Ho Jung discussed Texas’s emergence as a major investment hub, citing factors driving this interest, including favorable business conditions and strategic location.

The panel, which included Pete R. Acosta, Attaché, U.S. Customs and Border Protection at the U.S. Embassy Seoul, also explored the challenges faced by Korean employees in obtaining U.S. work visas, including the difficulties of navigating visa categories such as B-1, B-2, and ESTA. They provided guidance on the most suitable visa options and discussed the risks associated with these visas.

The session further examined the potential for creating an E-4 visa category specifically for Korean workers and discussed collaborative steps to streamline the visa process. The panelists emphasized the need for improved education on U.S. work visa procedures to ensure compliance and enhance success rates for Korean workers.

The seminar addressed how stakeholders can work together to sustain the momentum of Korean investments in the U.S. and optimize the U.S. work visa process for Korean companies and their employees. AMCHAM will also hold the annual Doing Business in the U.S. Seminar in October, which will go in-depth into work visas as well as other key elements of expanding into the U.S. market.

주한미국상공회의소, 미국 취업 비자 발급 절차 설명회 개최 

미국 시장 진출 및 확장을 모색하고 있는 국내 기업 및 개인을 위한  

다양한 비자 종류별 자격 조건 및 유의점 등 미국 취업 비자와 관련한 전반적인 정보 제공  

2024년 08월 14일 – 주한미국상공회의소 (회장 겸 대표이사 제임스 김, 이하 ‘암참’)가 오늘 오후 IFC 포럼에서 미국 취업 비자 발급 절차 설명회를 개최했다.   

금번 행사는 미국 시장 진출에 대한 국내 기업의 높아진 관심을 반영하듯, 전문가들로부터 미국 취업 비자와 관련한 전반적인 정보와 통찰을 얻고자 하는 다양한 업종의 암참 회원사를 포함한 많은 참석자들로부터 큰 호응을 얻었다. 이날 설명회를 통해 암참은 기업 및 개인에 적용되는 미국 취업 비자 가이드 전반을 다루며, 다양한 비자 종류별 신청 자격 조건 및 각 유형별로 허용되는 비즈니스 활동 영역 등에 대한 포괄적인 정보를 제공했다. 

제임스 김 암참 회장 겸 대표이사는 개회사를 통해, “지난 3년간 한국의 대미(對美) 투자 규모가 반도체, 전기차 배터리, 신재생에너지 등의 전략산업 분야에서 총 1,400억 달러를 넘어서는 등 전례 없는 수준에 이르고 있으며, 한·미 양국 경제·통상 파트너십의 가교로서 암참은 양국 산업 협력의 이렇듯 강력한 모멘텀을 인지하고 지지하고 있다.”고 말했다.  

이어 그는 “이러한 대규모 투자 흐름을 유지하기 위해 가용한 모든 시스템을 동원하여 지원해야 할 것인 바, 이를 위해 현장에서 힘써 주고 계신 영사과, 관세 및 국경보호청(CBP), 산업통상자원부, 외교부의 노력에 깊이 감사드린다.”고 말하며, “오늘 이 세션이 미국 취업 비자 취득에 있어 귀중한 통찰을 제공하여 한국 기업들과 그 직원들이 보다 효과적으로 이를 이해하고 활용하는 데 도움이 되기를 바란다.”고 덧붙였다.  

주한미국대사관 앤드류 게이틀리 상무공사는 축사를 통해, “대한민국은 미국의 신뢰할 수 있는 공급망 파트너.” 라고 말하며, “미국 內 설비 설립과 투자에 있어 주요 인력 배치는 필수적이며, 이러한 인력 배치가 적절한 비자를 통해 제대로 이루어지는 것이 한국 대미(對美) 투자 성공의 핵심.” 이라고 덧붙였다. 그는 또한, “미국대사관은 한국 기업이 미국에 기여하는 엄청난 가치를 깊이 인식하고 있으며, 앞으로도 한국의 대미(對美) 투자를 적극 지원하여 나갈 것.” 이라고 말했다.    

기조연설을 맡은 정만석 이민법인대양 수석 미국변호사는 또한, “미국 진출을 위한 첫 단추는 비자 문제를 해결하는 것.” 이라고 강조하며, “오늘 암참의 미국 취업 비자 발급 절차 설명회가 한국 기업의 미국 진출을 촉진시켜 한·미 양국의 경제 발전에 나비 효과가 될 수 있기를 바란다.”고 말했다.  한편, 이민법인대양, 한국무역협회(KITA), 주 휴스턴 총영사관, 주한미국대사관 관세 및 국경보호청에서 참여한 패널 토론을 통해 주요 법적 고려 사항을 포함하여 미국에 진출한 한국 기업의 취업 비자 관련 현황과 유의점 등 미국 취업 비자 시스템에 대한 전반적인 통찰을 나누었다.  

정희철 한국무역협회 국제협력실 미주실장은 테크놀로지, 신재생에너지 등 대미(對美) 투자 트렌드를 비롯한 투자 유치 현황에 대해 공유하였으며, 정영호 주 휴스턴 총영사는 주요 투자 중심지로 부상하고 있는 텍사스 주의 우호적 여건과 전략적 입지 등에 대한 정보를 전달했다.   

피트 아코스타 주한미국대사관 관세 및 국경보호청 주재관을 포함한 전문가들은 토론을 통해 한국인 직원들이 B-1, B-2 및 ESTA 등의 비자 취득에 있어 직면하는 애로사항을 탐색하고 올바른 비자 유형과 각 유형 취득 시 유의해야 할 리스크 등에 대한 지침을 제공하였으며, 나아가 한국인 직원들을 위한 E-4비자 신설 가능성, 비자 발급 절차 간소화 등에 대한 논의를 이어갔다.  

패널에 참여한 연사들은 또한 한국인 직원들의 비자 신청에 있어 절차 준수를 보장하고 취득률을 높이기 위한 교육의 중요성을 역설하며, 비자 발급 절차를 최적화함으로써 대미(對美) 투자의 모멘텀을 이어가야 한다는 데에 목소리를 모았다. 암참은 또한, 취업 비자 등 미국 시장 진출에의 핵심 요소를 다루는 연례 시그니처 행사인 ‘미국 시장 진출 세미나’를 오는 10월에 개최할 예정이다.
