AMCHAM Hosts a Policy Talks with Haksoo Ko,
Chairperson of the Personal Information Protection Commission
To share the PIPC’s policy focus, major changes to the ‘Personal Information Protection Act (PIPA)’and listen to the concerns of foreign businesses operating in Korea
April 18, 2023 – The American Chamber of Commerce in Korea (AMCHAM; Chairman and CEO James Kim) hosted a policy talks with Haksoo Ko, Chairperson of the Personal Information Protection Commission (PIPC), at the Grand Hyatt Seoul this afternoon.
At this event, Chairperson Ko met with a delegation of global companies in Korea to introduce the PIPC’s policy focus, major changes to the Personal Information Protection Act (PIPA) and encourage free exchange of opinions and concerns with the policy directions.
In his welcoming remarks, AMCHAM Chairman & CEO James Kim said, “One of AMCHAM’s key initiatives is to establish Korea as regional headquarters in Asia Pacific. At the core of Korea’s rise as regional headquarters is its robust digital infrastructure.” He continued, “Digital economy is key to the Indo-Pacific Economic Framework for the U.S. and Korea and free-flowing cross-border data transfer is an important enabler to unlock Korea’s potential as an innovation hub.”
He added, “I would like to express my sincere admiration for the exceptional leadership demonstrated by Chairperson Ko and the PIPC in driving data security policy in Korea. Their steadfast commitment to ensuring data protection has been crucial in promoting trust and confidence in the country’s digital ecosystem.”
Chairperson Haksoo Ko outlined the major changes to the Personal Information Protection Act (PIPA), which will take effect in September. The revisions include the improvement of personal information processing practices that used to rely solely on “consent”; the right to request the transfer of personal information; adjustment of the upper limit of fines to 3% or less of “total sales” (excluding sales not relevant to offense); diversification of personal information transfer requirements and strengthening of protection measures; introduction of new standards for mobile video devices such as drones, robots, self-driving cars ; and alignment of online and offline regulations.
Chairperson Ko also shared PIPC’s major achievements since its establishment as an independent government agency, including case studies of global big tech companies such as Google and Meta.
The Chairperson pledged to invest in R&D of privacy-related technologies, support data usage for development of AI and new technologies and strive to provide on privacy protection in new technologies.
Chairperson Ko said, “The field of privacy is expanding rapidly around the world, and South Korea has been active in protecting privacy, including through the amendment of the Personal Information Protection Act. We hope that this event will serve as an opportunity to make digital norms for new era.”

주한미국상공회의소, 고학수 개인정보보호위원장 초청 정책 간담회 개최
개인정보보호위원회 정책 방향과 개인정보 보호법 주요 개정 내용 소개 및 외투기업 의견 청취
2023년 04월 18일 – 주한미국상공회의소 (회장 겸 대표이사 제임스 김, 이하 ‘암참’)가 오늘 오후 그랜드 하얏트 서울 호텔에서 고학수 개인정보보호위원회 (이하 ‘개인정보위)’ 위원장을 초청하여 정책 간담회를 개최했다.
이번 정책 간담회를 통해 고학수 위원장은 글로벌 기업 대표단과 만나, 최근 의결된 ‘개인정보 보호법’ 주요 개정 내용과 개인정보위가 추진하고 있는 정책 방향 등을 소개하고 글로벌 기업들의 관련 의견을 청취했다.
제임스 김 암참 회장 겸 대표이사는 환영사를 통해, “암참의 주요 미션 중 하나는 한국을 아태지역 비즈니스 허브로 발돋움하도록 돕는 것이며, 한국이 가진 무한한 잠재력의 핵심에는 강력한 디지털 인프라가 있다.” 고 말하며, “디지털 경제는 한·미 인도-태평양 경제 프레임워크의 핵심이며 국경간 자유로운 데이터 이전은 혁신 허브로서의 한국의 잠재력을 발현케 할 매우 중요한 요소.” 라고 덧붙였다. 그는 이어 “데이터 보호 보장을 위한 개인정보위와 고 위원장의 확고한 의지와 노력은 국내 디지털 생태계에 대한 신뢰 증진에 매우 큰 역할을 했다. 국내 데이터 보안 정책 추진 과정에서 보여준 고학수 위원장의 확고한 의지와 탁월한 리더십에 대해 깊은 존경을 표한다.” 라고 말했다.
고학수 위원장은 강연을 통해 먼저 오는 9월 시행 예정인 ‘개인정보 보호법’의 주요 개정 내용을 공유했다. 이번 개정안에는 ▲'동의'에만 의존하던 개인정보 처리 관행 개선 ▲전 분야 마이데이터 확산을 위한 개인정보 전송요구권 신설 ▲과징금 상한액 '전체 매출액'의 3% 이하로 조정 (위반행위 관련 없는 매출 제외) ▲개인정보 국외이전 요건 다양화 및 보호조치 강화 ▲자율주행차, 드론, 배달 로봇 등 이동형 영상기기의 특성에 맞는 운영기준 신설 ▲온·오프라인 규제 일원화 등의 내용이 담겼다.
고 위원장은 또한 구글·메타 등 글로벌 빅테크 기업에 대한 처분 사례 등 독립 감독기구 출범 이후의 주요 성과를 공유하기도 했다.
앞으로 개인정보위는 개인정보 관련 기술의 다양한 연구·개발에 투자하고 AI 및 신기술 개발을 위한 데이터 활용을 지원하면서 신기술과 관련한 개인정보 보호 법제를 마련하는 데도 노력을 기울일 방침이다.
고학수 위원장은 끝으로, “세계적으로 개인정보 영역은 빠르게 확장되고 있으며 한국은 개인정보 보호법 개정 등 개인정보 보호를 위해 활발하게 활동하고 있다.” 면서, “이 자리를 계기로 새로운 시대에 걸맞는 디지털 규범 마련의 포석이 되기를 바란다.” 라고 말했다.
