AMCHAM Hosts a Policy Talks with Haksoo Ko, Chairperson of the Personal Information Protection Commission To share the PIPC’s policy focus, major changes to the ‘Personal Information Protection Act (PIPA)’and listen to the concerns of foreign businesses operating in KoreaApril 18, 2023 – The American Chamber of Commerce in Korea (AMCHAM; Chairman and CEO James Kim) hosted a policy talks with Haksoo Ko, Chairperson of the Personal Information Protection Commission (PIPC), at the Grand Hyatt Seoul this afternoon. At this event, Chairperson Ko met with a delegation of global companies in Korea to introduce the PIPC’s policy focus, major changes to the Personal Information Protection Act (PIPA) and encourage free exchange of opinions and concerns with the policy directions. In his welcoming remarks, AMCHAM Chairman & CEO James Kim said, “One of AMCHAM’s key initiatives is to establish Korea as regional headquarters in Asia Pacific. At the core of Korea’s rise as regional headquarters is its robust digital infrastructure.” He continued, “Digital economy is key to the Indo-Pacific Economic Framework for the U.S. and Korea and free-flowing cross-border data transfer is an important enabler to unlock Korea’s potential as an innovation hub.” He added, “I would like to express my sincere admiration for the exceptional leadership demonstrated by Chairperson Ko and the PIPC in driving data security policy in Korea. Their steadfast commitment to ensuring data protection has been crucial in promoting trust and confidence in the country’s digital ecosystem.” Chairperson Haksoo Ko outlined the major changes to the Personal Information Protection Act (PIPA), which will take effect in September. The revisions include the improvement of personal information processing practices that used to rely solely on “consent”; the right to request the transfer of personal information; adjustment of the upper limit of fines to 3% or less of “total sales” (excluding sales not relevant to offense); diversification of personal information transfer requirements and strengthening of protection measures; introduction of new standards for mobile video devices such as drones, robots, self-driving cars ; and alignment of online and offline regulations. Chairperson Ko also shared PIPC’s major achievements since its establishment as an independent government agency, including case studies of global big tech companies such as Google and Meta. The Chairperson pledged to invest in R&D of privacy-related technologies, support data usage for development of AI and new technologies and strive to provide on privacy protection in new technologies. Chairperson Ko said, “The field of privacy is expanding rapidly around the world, and South Korea has been active in protecting privacy, including through the amendment of the Personal Information Protection Act. AMCHAM Hosts a Special Meeting with Han Ki Jeong, Chairperson of the Korea Fair Trade Commission To share the KFTC’s policy direction for 2023 and listen to the concerns of foreign businesses operating in Korea To seek ways on improving Korea’s competitiveness as regional headquarters in Asia Pacific March 20, 2022 – The American Chamber of Commerce in Korea (AMCHAM; Chairman and CEO James Kim) hosted a special meeting with Han Ki Jeong, Chairperson of the Korea Fair Trade Commission (KFTC), this afternoon. The meeting aimed to introduce the KFTC’s major policy initiatives in 2023 and encourage free exchange of opinions on management difficulties and solutions. About 80 representatives from domestic and foreign companies, including the AMCHAM Board of Governors, attended the special meeting held at the Grand Hyatt Seoul. In his welcoming remarks, AMCHAM Chairman & CEO James Kim said, “AMCHAM’s key initiative is to establish Korea as a regional innovation hub in the Asia Pacific. To unlock Korea’s true potential, it is critical that the business environment is fair and transparent for both domestic and foreign businesses and regulations are consistent with global standards.” He added, “AMCHAM deeply appreciates Chairman Han’s vision to promote innovative and fair competition and to increase transparency and predictability of the KFTC enforcement practices and we will also accelerate its effort this year to promote greater economic growth in Korea.” Chairperson Han Ki Jeong of the KFTC stated that the surge of online and contactless transactions after the COVID-19 pandemic has accelerated the transition to the digital economy. There is increased demand for swift and effective damage relief as low growth exacerbates the difficulties of both businesses and the public. He emphasized the need to respond to the digital economy and promote market fairness. According to Chairperson Han, the main tasks of the KFTC are to create a market environment that facilitates innovative competition, promote fair trading for SMEs and small businesses, ensure better regulations for large business groups, and create a trade environment that guarantees consumer rights and interests. Chairperson Han first cited the creation of a market environment that facilitates innovative competition as a key task for the KFTC this year. In particular, he explained that the KFTC will correct the abuses of market power in digital economy-based industries, such as semiconductors and app markets, and platform industries, such as mobility and e-commerce platforms. Regarding the issue of the monopoly of global Big Tech firms, which has been subject to intensive regulations and policies in countries around the world in recent years, the KFTC will respond with systemic efforts including effective regulatory system via stronger international cooperation. Chairperson Han also pledged to closely review mergers that undermine innovation. He added that the KFTC will crack down on collusion and unfair trade practices in order to root out market rule violations. The Chairperson went on to say that in order to guarantee fair compensation for innovation efforts by SMEs and small businesses and correct unfair subcontracting practices, the KFTC will implement various measures such as enacting a law that reflects an increase in raw material costs into supply prices, closely monitoring unfair subcontracting practices in service and “Ppuri” industries and reducing the burden on franchisees and small suppliers. Chairperson Han also said he will focus on monitoring unfair intra-group transactions that hinder fair competition, which intend to transfer business ownership by exploiting legal loopholes, undermine the SMEs' ground for competition and support non-performing affiliates. He will review unfair intra-group transactions that use expedient means by monitoring new financial products such as TRS and reviewing relevant regulations. He also said that KFTC will push for revisions of the guidelines for tunneling to make more reasonable standards to determine the unfairness of tunneling and exceptional conditions. Regarding adjusting regulations for large business group to economic growth, it was announced that KFTC will make the guidelines for the same person designation including standards for designating and changing the same person. The thresholds of designating business group subject to disclosure will be reviewed more reasonable by considering them with asset-to-GDP ratio or raising the threshold, and disclosure regulation will be improved to make corporate disclosures more effective and reduce the burden of companies. To create a trading environment that guarantees consumer rights and interests, there are plans to prevent digital consumer fraud, protect consumer in C2C transactions, ease the requirements for issuing preliminary injunctions and ease the conditions for application of collective mediation. He added that the KFTC will enact the Act on Consumer Safety, develop specific criteria to identify "greenwashing" and monitor unfair terms and conditions and unfair practices in various subscription services, live commerce, travel and hospitality. This year, the KFTC is particularly focused on reforming law enforcement to meet the expectations of the people and the market. To this end, KFTC will improve the overall process, standards and capacity of its case handling. Explaining recently announced plans for organizational reform, he said that by separating the Investigation and Policy bureaus, the organization will achieve more effective, responsible and specialized management of cases. Also, by further separating the roles of Investigation and Deliberation bureaus, the organization will strengthen the independence and fairness of trial decisions. At this event, Deputy PM Choo Kyungho met with a delegation of American companies in Korea to share his vision for creating a better foreign investment environment to enhance South Korea's competitiveness, and measures for revitalizing the economy and insights on how businesses should navigate the challenging economic landscape this year. Conducted earlier this year, this survey collected AMCHAM members’ opinions on the business environment and the competitiveness of Korea in the region. For the second year in a row, Korea was ranked as second most preferred destination for regional business headquarters in Asia, after Singapore. Labor policy, tax policy, CEO liability, IP protection and digital economy were cited as the top five areas that need reform for Korea to realize its potential as regional headquarters. Chairman & CEO Kim also outlined seven key policy proposals to boost Korea’s competitiveness compared to other regional business hubs, such as Singapore, Tokyo and Hong Kong. At this event, Dr. Suh met with 50 U.S. and Korean corporate representatives, including members of the AMCHAM Board of Governors, to share her insights on the global and Korean economy for 2023 as well as key risk factors. In his welcoming remarks, AMCHAM Chairman & CEO James Kim said, “As we commemorate the 70th anniversary of U.S.-Korea relations and the founding of AMCHAM Korea this year, one of AMCHAM’s key initiatives is to establish Korea as regional headquarters in Asia Pacific. Given the robust infrastructure, human talents, and sound monetary policies, we believe Korea is well positioned to realize its potential as a business hub.” He continued, “We truly appreciate the remarkable leadership of the Bank of Korea and Board Member Suh Young Kyung in enabling sustainable economic growth for Korea.” He added, “While there are uncertainties and challenges in the global economy this year, we remain optimistic that the Korean Government, with its strong commitment to delivering economic reforms, will be able to navigate the economic landscape wisely. AMCHAM will also continue to accelerate its effort this year to promote greater economic growth in Korea.”Dr. Suh Young Kyung delivered a keynote speech on the theme of “Economic Outlook and Risk Factors.” She pointed out that the global economy will continue to face difficulties with global inflation remaining high and growth slowing compared to last year. However, global economic conditions have somewhat improved due to recent adjustments in the pace of monetary policy tightening of major countries, the ease of the European energy crisis and the recovery of the Chinese economy. She also mentioned that the outlook on the U.S. economy is mixed, adding that pessimists warn of a hard landing while optimists think a soft landing can be navigated, given the strength in employment condition.Dr. Suh predicted that Korea’s domestic economic growth is slowing, forecasting growth at 1.7% in 2023. She determined that this is due to a decline in exports and weakened domestic demand. Furthermore, she forecast that the Korean economy will face great uncertainty this year as overall employment conditions have worsened in both quantity and quality. Given the Chinese economy’s speed of recovery, increased household debt, falling housing prices, financial markets instability and widening gaps in interest rates between the U.S. and Korea, uncertainty in the economy is expected to continue. It was also analyzed that global supply chain issues will remain a challenge for Korean companies heavily reliant on exports as the global economic order rapidly changes its direction to becoming online and environmentally friendly. Dr. Suh highlighted that a structural weakness of the Korean economy that was revealed by the COVID-19 pandemic was the inequality in growth. She emphasized that the biggest structural problem the Korean economy faces is the change in demographics, which would cut into the country's growth potential in the mid- to long-term. In her final remarks, Dr. Suh said, “Going forward, the Board will continue to conduct monetary policy that contributes to stable economic growth through maintaining price and financial stability while thoroughly assessing changes of economic conditions at home and abroad.” ### 주한미국상공회의소, 서영경 한국은행 금융통화위원 초청 특별 간담회 개최 국내·외 경제 흐름의 특징과 전망, 주요 리스크 요인 등 검토 한국은행 통화정책 방향 이해를 통한 한·미 경제 협력 강화 전략 모색2023년 02월 07일 – 주한미국상공회의소(암참; 회장 겸 대표이사 제임스 김)가 오늘 오전 서영경 금융통화위원을 초청하여 특별 간담회를 개최했다. 이번 간담회는 올 해 국내·외 경제 흐름에서 나타나는 특징과 주요 리스크 요인에 대한 면밀한 검토를 통해 국내 외투기업의 한국은행 통화정책에 대한 이해와 경제 전망에 맞는 대응 전략 수립을 돕기 위해 마련되었다. 그랜드 하얏트 서울 호텔에서 진행된 이번 특별 간담회에는 암참 이사진을 포함하여 국내·외 기업 대표 50여명이 참석했다. 제임스 김 암참 회장 겸 대표이사는 환영사를 통해, “올해로 70주년을 맞이하는 암참의 주요 미션 중 하나는 대한민국을 아시아 태평양 지역 본부로 발돋움 하도록 돕는 것이다. 대한민국이 가진 강력한 인프라와 인적 자원, 그리고 건전한 통화 정책을 고려할 때, 한국은 비즈니스 허브로서의 잠재력을 실현할 수 있는 좋은 위치에 있다.” 라고 말하며, “한국의 지속 가능한 경제 성장을 위한 한국은행과 서영경 위원의 놀라운 리더십에 진심으로 감사드린다.” 라고 덧붙였다. 그는 또한 이어, “한국은행 금융통화위원회의 노력과 경제 개혁을 향한 한국 정부의 의지가 있기에 험난한 경제 지형을 현명하게 헤쳐 나갈 수 있으리라 믿는다. 암참은 앞으로도 한·미 양국간 경제 협력 강화를 위한 가교 역할을 더욱 충실히 해 나가겠다.” 라고 말했다. “Economic Outlook and Risk Factors”를 주제로 하는 모두발언을 통해 서영경 금융통화위원은 금년도 세계 경제는 인플레이션이 지속되고 성장률이 전년보다 하락하는 어려운 상황이 이어질 것으로 전망하였다. 다만 최근 주요국의 통화정책 긴축속도 조정, 유럽 에너지 위기 완화, 중국경제 회복 등으로 세계경제 여건이 다소 개선되었다고 분석했다. 그는 또한, 미국 경제에 대한 전망은 엇갈리고 있다고 말하며, 비관론자들은 경착륙을 경고하는 반면, 낙관론자들은 고용지표 호조세를 감안할 때 연착륙이 가능하다고 보고 있다고 덧붙였다. 서 위원은 또한 국내 경제 성장세도 둔화되고 잇다고 말하며, 한국의 올해 경제 성장 전망치를 1.7%로 제시했다. 이는 수출이 큰 폭으로 감소하고 소비 회복 흐름이 약화된 탓이라고 분석했다. 고용상황이 전반적으로 양과 질 측면에서 모두 악화되고 있고, 중국 경제의 회복속도, 주요국 경기 흐름, 금리인상으로 이한 가계부채 부담, 집값 하락과 금융시장 불안정, 한·미 양국간 금리 격차확대로 인한 자본이탈 우려 등으로 향후 경제상황의 불확실성이 당분간 이어질 것으로 예측했다.또한, 세계 경제 질서가 온라인과 환경 친화적으로 빠르게 방향을 선회하면서 글로벌 통상 환경과 패러다임이 급변하고 있어 글로벌 공급망 위기는 수출 의존도가 높은 한국 기업에 여전한 과제가 될 것이라고 분석했다. 코로나19로 드러난 한국 경제의 구조적 약점은 성장의 불균형이라고 지적하며, 한국경제가 직면한 가장 큰 구조적 문제는 인구구조 변화로, 이는 중장기적으로 국가의 성장 잠재력을 약화시킬 위험이 있음을 강조했다. 서영경 위원은 끝으로, “향후에도 금통위는 국내·외 경제여건의 변화를 면밀히 점검하면서 물가안정과 금융안정을 통해 국내 경제의 안정적 성장을 도모할 수 있도록 통화정책을 운용해 나가겠다.” 고 밝혔다.
