“Export Control Reform and Re-Export Considerations” 

 

Dear AMCHAM Members,? 

We trust you are enjoying the pleasant autumn weather and colors! We are fortunate to have a member of the United States government speak to us on recent developments on US laws and regulations that should result in increased trade between the United States and Korea -- particularly with respect to military munitions. Kevin J. Wolf is the Assistant Secretary of Commerce for Export Administration, Bureau of Industry and Security, U.S. Department of Commerce. 

 

Prior to his appointment, Mr. Wolf was a partner in the Washington D.C. office of Bryan Cave LLP specializing in international trade for nearly 17 years. His areas of practice focused on International Traffic in Arms Regulations (ITAR), Export Administration Regulations (EAR), Foreign Corrupt Practices Act (FCPA), multilateral trade controls, and sanctions administered by the Office of Foreign Assets Control (OFAC).

 

Among other issues, Mr. Wolf will discuss the US Export Control Reform Initiative which seeks to remove certain military items from controls and restrictions (e.g., under ITAR, EAR) and, thus, allow their sale and export (and re-export) without prior consents and other restrictions from the U.S. government. He will also discuss a “license exception” permitted under the Strategic Trade Authorization that facilitates license-free exports to defense supply chains in 36 allied and partner destinations, including South Korea.
